Welcome to the Potatopak New Zealand website. You are visiting our online shop where you are able to buy our range of 100% biodegradable products for delivery both within New Zealand and internationally. Note that for international orders, you must contact us by phone or email as we do not ship outside of New Zealand for purchases over the internet.

When you purchase goods using Potatopak's website, you may also wish to join the Potatopak family. By giving us more detailed information about yourself, we will be able to provide you with information and special offers tailored to your specific needs and interests.

Acceptance of terms and conditions

We have created these Terms and Conditions as part of our overall objective to make this website easy to use, reliable, and secure and a valuable experience for you.

These Terms and Conditions apply to the use of this website and the goods available through it. By using this website, you are deemed to have read and agree to be bound by these Terms and Conditions.

If you do not accept these Terms and Conditions, you should refrain from using this website.

Our Guarantee

Potatopak NZ Limited guarantees the quality of all of our products - you can order from Potatopak with complete confidence. If for any reason you are not totally satisfied with the goods you receive you may return them.

Return and Refund Policy

Goods which are in stock will be delivered within 2 to 4 working days from the date of your order. We’ll let you know if your goods are on back order.

We use couriers for all our deliveries. We do not ship outside of New Zealand for purchases over the internet.

We are proud of our products. However should you not be entirely happy with your purchase, or if you receive damaged or defective merchandise, we will either issue a refund or exchange the item upon its return. You will not be charged any additional shipping or handling fees for replacement. That is our promise.

As the goods will have left us in perfect condition you must ensure that they are still in perfect condition before you sign for them. All claims for goods damaged in transit must be made to the carrier immediately on delivery of the goods to you and you must advise us of this.

Prices, Specifications and Availability

All prices exclude handling and freight. Potatopak reserves the right to update prices and specifications at any time without notice. We make great efforts to ensure the prices and specifications of our goods are as accurate and as up to date as possible.

Handling and Freight

Handling and freight is calculated in addition to the price of the goods, and costs are based on the aggregate order being shipped (unless otherwise stated on the product selected) and the destination to which the goods are being dispatched in New Zealand.

For overseas shipments and some larger items, we will need to quote you on the cost of handling and freight – when you select these items into your shopping basket you will have the option to request a quote from us. For these items you will be contacted to confirm your order, at which time we will process your order and payment.

Customer Warranties and Indemnities

The Consumer Guarantees Act 1993 (New Zealand) applies only to consumer purchases. If you acquire or hold yourself out as acquiring for the purposes of a business any goods or services to which these Terms and Conditions apply, the provisions of the Consumer Guarantees Act 1993 (New Zealand) will not apply to our supply of such goods or services.

In these circumstances the only warranty offered by Potatopak other than as required by New Zealand law (express or implied, or otherwise) is the manufacturers warranty accompanying the goods and you will indemnify us against any failure by you or your customers to properly contract out of liability to business end consumers under the Consumer Guarantees Act 1993 (New Zealand).

Our total liability to you in relation to any faulty goods or services is limited to the price of those goods or services. We will not, in any case, be liable for any consequential or special damages, including loss of business profits.

It should be noted that warranties applicable in New Zealand do not extend beyond those shores.

Risk and Ownership of the Goods

Risk in the goods will pass to you, the customer, upon delivery to you or to the address specified by you. Pending cleared payment in full of all monies due under this contract or in respect of any other monies owed by you to Potatopak the goods will remain the sole and absolute property of Potatopak as legal and equitable owner.


Payment for Purchases

Unless you are a trade business customer of Potatopak with approved trade credit payment for goods and services on our website can only be made by direct credit through your bank to our bank account or by credit card (we accept American Express, VISA, MasterCard, and Diners).

Your credit card will be charged at the time when you submit your order.

Quote requests will only be charged to your credit card when the quote is confirmed by you.

Order Fulfilment

Potatopak will endeavour to fill and dispatch all orders received via the secure site by the end of the next business day after receipt of the order, except where the product ordered is not available, in which case you will be notified and will have the option to cancel, vary the order or wait for the product to become available.

Customs

You may be subject to import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you. We have no control over these charges and cannot predict what they may be.

Customs policies vary widely from country to country; you should contact your local customs office for further information. Additionally, when ordering from our store, you are considered the importer of record and must comply with all laws and regulations of the country in which you are receiving the goods.

Privacy

When you order from Potatopak we gather personal details from you such as your name, billing address, delivery address, phone number, email address and credit card data. This information is used solely to fulfil your order.

Your personal information is stored in a secure and responsible way and is not available to unauthorised persons. We may retain this information to assist you with repeat visits. Should you wish to amend or delete certain details in the information that is held about you, you may do this online.

Potatopak will hold all information securely and will not disclose except for these purposes or when required by law. The Privacy Act provides you with the right to see and correct personal information about you that Potatopak holds.

Any contact or credit card details you send us will be processed through a secure page. Contrary to popular opinion, websites that employ security features like ours, offer you more effective protection than most offline merchants that accept credit cards.
